Applying for a hazardous waste treatment license is a complex process that requires careful preparation and compliance with legal regulations. This process includes steps from preparing documents, submitting a license application, to assessment and approval by the competent authority. To ensure the process goes smoothly, businesses need to clearly understand the requirements for documents, technical standards and other necessary conditions. This article will provide detailed instructions on the order and procedures for applying for a hazardous waste treatment license, helping you better understand this legal process.
Step 1. Submit application
Organizations and individuals submit 02 sets of application documents for a Hazardous Waste Treatment License; according to regulations to the Ministry of Natural Resources and Environment.
Step 2. Check profile
The licensing authority shall check the completeness and validity of the dossier and notify in writing the organization or individual to request correction or supplementation of the dossier (if any).
Step 3. Approve the Trial Operation Plan and consult the local Department of Natural Resources and Environment (if any)
Within 10 (ten) working days from the date of completion of the review of the registration dossier, the licensing authority shall review the hazardous waste treatment trial operation plan and notify the organization or individual to amend or supplement (if any).
Within 10 (ten) working days from the date of completion of the review of the hazardous waste treatment trial operation plan, the Licensing Authority shall issue a written approval of the trial operation plan according to the form in Appendix 5.D of Circular 36/2015/TT-BTNMT.
Step 4. Organizations and individuals conducting trial operations for hazardous waste treatment (if any)
The registered entity is permitted to temporarily collect, transport or receive hazardous waste for trial operation. The licensing authority may conduct surprise inspections of the facility; take monitoring samples during the trial operation.
Step 5. Notification of trial operation results (if any)
After completing the hazardous waste treatment trial operation; the organization or individual shall submit 02 (two) copies of the hazardous waste treatment trial operation results report; according to the form prescribed in Appendix 5.D Circular 36/2015/TT-BTNMT to the licensing authority. In case within 06 (six) months from the date of approval; there is no report or no extension registration document; or explanation sent to the licensing authority, the trial operation must be re-registered. In case the trial operation result report does not meet environmental technical standards; has incomplete or unfinished content; the licensing authority shall notify the organization or individual to adjust; complete or re-test operation.
Step 6. Organize inspection, assessment of conditions and licensing of hazardous waste treatment
After receiving the report on the results of the hazardous waste treatment trial operation and the document of the Department of Natural Resources and Environment (if any); the licensing authority shall organize an on-site inspection at the hazardous waste treatment facility; hazardous waste transfer station (if any); and at the same time, choose to conduct one of the following two activities to assess the conditions for granting a Hazardous Waste Treatment License:
Establish a Technical Advisory Group on licensing hazardous waste treatment (comprising experts in the environment and other relevant fields);
Organize to get opinions from experts or related organizations and individuals.
Other cases
In case an organization or individual does not meet the conditions, technical requirements, and management procedures as prescribed, the licensing authority shall notify in writing or include it in the inspection report.
After receiving the completed registration dossier according to regulations, the licensing authority shall consider and issue the Hazardous Waste Treatment License. In case after 06 (six) months the organization or individual does not resubmit the dossier or does not have a reasonable explanation in writing according to regulations, the registration dossier shall be reconsidered from the beginning.
