The legality of real estate projects in Vietnam involves various important documents to ensure legality and safety for investors. In 2023, legal regulations have been updated to protect the interests of all parties involved. This article provides detailed information on the necessary documents, helping you understand the legal process and prepare for real estate investment legally and effectively.
According to the provisions of Article 55, Article 56 of the Law on Real Estate Business 2014; Clause 17, Article 1, Decree 148/2020/ND-CP mentioned above, a real estate project may have the following documents:
1. Have an investment policy decision/Investment certificate/project approval;
2. Have 1/500 approval or total site approval;
3. Documents on land use rights;
4. Documents of completion of financial obligations related to land;
5. Have a construction permit (in cases where a construction permit is required);
6. Project documents and construction drawing designs have been approved by competent authorities;
7. Construction permit in cases where a construction permit is required;
8. Documents on acceptance of completion of construction of corresponding technical infrastructure according to project progress; In the case of an apartment building or mixed-use building with residential purposes formed in the future, there must be a record of acceptance of the completed foundation of that building (if you want to sell it). real estate form in the future)
